II. BRIEF OVERVIEW OF CONTEST
The Official Win A $10,000 Sports Getaway Package (the "Contest") is an Enter-to-Win contest. Participants can willingly submit an entry form at Nielsen Jeep Chrysler Dodge Ram located at 175 Route 10 in East Hanover, NJ store or online at www.nielsendodge.com. Contest Administrators will randomly choose the winning entry and prizes will be awarded in accordance with these Official Rules.
III. BINDING AGREEMENT
In order to enter the Contest, you must agree to these Official Rules ("Rules"). The Rules consist of the terms and conditions on this page and the Entry Form and Consent Form ("Contest Materials"). Because you will be bound by these Rules and these Rules will form a legally binding agreement with respect to this Contest, please read them carefully. You may not submit an entry to the Contest and you will not be eligible for the prizes described in these Rules unless you agree to these Rules. You agree that an entry in the Contest constitutes your agreement to these Rules.
IV. ELIGIBILITY
Open and offered only to legal residents of the 50 United States and District of Columbia, who are 18 years of age or older as of September 5th, 2012. Employees and directors of Nielsen Jeep Chrysler Dodge Ram and its parent, subsidiaries and affiliated companies, advertising, promotion or production agencies, and their immediate family members or individuals residing in their same household (whether related or not), are not eligible to participate or win a prize.
V. PROMOTION PERIOD
The Contest begins at 12:00:01 a.m. Eastern Standard Time (ET) on September 5th, 2012 and ends on 11:59:59 p.m. Eastern Standard Time (ET) on Friday, January 18th, 2013.
VI. HOW TO ENTER
Participating contestants may enter the Contest using one of two (2) methods described below:
(1) In-Store: During the Promotion Period, visit Nielsen Jeep Chrysler Dodge Ram and submit an Enter-to-Win form. Form must be completed in its entirety to be eligible. Completed forms must be placed in the clearly marked Enter-to-Win box at Nielsen Jeep Chrysler Dodge Ram. All entries must be received no later than store closing on Friday, Jan 18th, 2013.
(2) Online: During the Promotion Period, visit www.nielsendodge.com/drawing.htm Form must be completed in its entirety to be eligible. You will then receive one (1) entry into the contest. All entries must be received no later than 11:59:59 p.m. ET on Friday, January 18th, 2013.
VII. RANDOM DRAWING
Contest Administrator will select one (1) winner from all eligible entries in a random drawing on January 19th, 2013. Winner must be present at Nielsen Jeep Chrysler Dodge Ram located at 175 Route 10, East Hanover, NJ on Saturday, January 19th, 2013 at 6pm to win. If first drawn winner is not present at Nielsen Jeep Chrysler Dodge Ram located at 175 Route 10, East Hanover, NJ on Saturday January 19th, 2013 at 6pm another random winner will be drawn and will continue until a winner who is present is selected. Limit one (1) prize per person/household. Odds of winning depend on the number of entries received.
VIII. PRIZE
One winner will receive one (1) $10,000 gift card from Golden Sports Tours which can be used to book a sports getaway package with Golden Sports Tours. The $10,000 gift card is not redeemable for cash and must be used within 1 year of January 19th, 2013.
Winner is solely responsible for any and all local, state and federal taxes incurred upon claiming a prize. Winner will be issued 1099 form for prize. Prizes awarded totaling $600 or more are required by state and federal law to claim prize value on 1099 tax form.
IX. GENERAL RULES
Nielsen Jeep Chrysler Dodge Ram and its agencies are not responsible for lost, late, delayed, incomplete, illegible, mutilated or misdirected entries, entries not received by the entry deadline, or for electronic, network or computer failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in this Contest, or other hardware, software or technical errors of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any material in connection with the Contest. Nielsen Jeep Chrysler Dodge Ram assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or insufficient space in user's e-mail account to receive e-mail. Nielsen Jeep Chrysler Dodge Ram reserves the right to cancel or modify the Contest (or any portion thereof) if fraud, misconduct or technical failures destroy the integrity of the Contest or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest as determined by Contest Administrator, in their sole discretion. If the Contest is so cancelled, judging will be conducted from among all eligible entries received prior to the time of termination. In the event a dispute arises regarding specific individual entitled to receive prize, entry will be deemed made by the authorized e-mail account holder. Authorized e-mail account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Any damage made to the Web site will also be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. Any use of robotic, automatic, programmed or the like methods of participation will void all entries by such methods. Nielsen Jeep Chrysler Dodge Ram reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. Internet caution: Any attempt by an individual to deliberately damage any web site or undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Nielsen Jeep Chrysler Dodge Ram reserves the right to seek damages from any such individual to the fullest extent of the law. No substitution, cash redemption or transfer of prize by winner permitted. Potential Winners may be required to sign and return a Liability Release and Publicity Release (where legal) within 14 days of notification. Non-compliance with this requirement, or if prize/prize notification is returned as non-deliverable, or if winner is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited and will be awarded to an alternate winner. The Contest is subject to all applicable federal, state and local laws and regulations. Entrants, by participating in this Contest, hereby waive and release, and agree to hold harmless the Nielsen Jeep Chrysler Dodge Rams, its parents, subsidiaries, affiliates, distributors, licensors, advertising and promotion agencies and all of their respective officers, directors, employees and representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death, and /or property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of any end good obtained with the prizes or their participation in this Contest, or any prize-related activity. By participating in this Contest, entrants agree to be bound by the Official Rules and the decisions of the judges. Except where prohibited by law, by accepting a prize, winners agree that Nielsen Jeep Chrysler Dodge Ram and its related and affiliated companies may use the winner's name, address (city, state), photograph, videotape, likeness, and/or prize information for advertising, publicity and promotional purposes and to the use of statements made by or attributed to winner relating to Nielsen Jeep Chrysler Dodge Ram, its related and affiliated companies or to this Contest and grants to Nielsen Jeep Chrysler Dodge Rams, and its related and affiliated companies any and all rights to said use without further notice and/or compensation except where prohibited by law.
